The opinion of the court was delivered by In this workmen's compensation case the commissioner made
findings and an award in favor of claimant, the widow and sole
dependent of a deceased workman, which the trial court approved
and adopted. The respondent and insurance carrier appeal, and
contend the trial court erred as a matter of law in two respects
in rendering judgment against them: First, in finding there was
substantial competent evidence that (1) the decedent met with
personal injury by accident, (2) the accidental injury arose out
of and in the course of decedent's employment, (3) the
relationship of employer and employee existed at the time of the
alleged accidental death; and second, that written claim for
compensation made November 15, 1955, was within the time provided
by the statute. The facts are undisputed and may be summarized as follows: John
M. Pinkston, the deceased workman, was a motorcar salesman and
had been in the employment of respondent since 1934.
